By purchasing and or accessing The OSP Training Academy you the purchaser (herein referred to as “you” or “You”) understand and acknowledge that you are entering into an agreement with Erin Mortenson LLC and agree to abide by the terms of this Course User Agreement and Terms of Use governing The OSP Training Academy and ErinMort.com (individually or collectively the “Website”). Additionally, you understand your purchase and access to OSP constitutes consent to Erin Mortenson LLC’s Privacy Policy posted on the Website, as revised from time to time. You have had the chance to review the Privacy Policy posted on the Website prior to purchase and access to OSP.
Subject to the terms of this Agreement, Erin Mortenson LLC hereby grants to you a limited, non-transferable, royalty-free and non-exclusive license to access OSP and its related course materials strictly in accordance with the terms and conditions set forth in this Agreement. Any violation of this Agreement shall result in but not limited to revocation of access to the OSP content with no right to refund of monies paid and/or criminal prosecution or filing of civil lawsuit.
You may access OSP and associated course materials including videos, voice recordings, private Facebook groups, worksheets, guides, and checklists (the “Content”) only for your personal educational purposes. You may not permit anyone else to use your account to access the Website or accompanying Content, including any resources provided by third parties that Erin Mortenson LLC makes available to those enrolled. You are responsible for maintaining the security of your account access credentials (including any username or password used to access resources on or through the Website), and you are responsible for any unauthorized use of your account. It is a violation of this Agreement for anyone to access OSP or the Content
without Erin Mortenson LLC’s express written authorization. You agree to notify Erin Mortenson LLC promptly if you suspect unauthorized use of your account. Until you notify Erin Mortenson LLC, you remain solely responsible for such unauthorized use and any damages that may result therefrom. Any sharing or unauthorized use of your personal credentials by a third party to access OSP or its Content shall be considered a violation of Erin Mortenson LLC’s intellectual property rights in a manner of which monetary damages would not be sufficient and all legal remedies shall be pursued.
UNAUTHORIZED COPYING, REPRODUCTION, REPUBLISHING, UPLOADING, DISTRIBUTING, FORWARDING, POSTING, SUMMARIZING, TRANSMITTING OR DUPLICATING ANY OF THE MATERIAL AVAILABLE ON THE OSP TRAINING ACADEMY IS STRICTLY PROHIBITED.
You may download any materials that are explicitly downloadable from OSP for personal, noncommercial educational and informational purposes, provided that the documents are not modified or resold for similar purposes including but not limited to business live events, social media content, workshops, webinars, info-products, or e-courses unless expressly provided in a separate written agreement.
“OSP Training Academy” , “OSP”, and other names, logos and marks related to Erin Mortenson LLC and its services are trademarks and/or service marks of Erin Mortenson LLC, and are protected by law. Erin Mortenson LLC reserves all rights to its trademarks and service marks, which may only be used with the prior written permission of Erin Mortenson LLC. Fair use of the trademarks and service marks requires proper acknowledgment. Nothing in this Agreement grants or transfers to you or to any third party any ownership rights in the OSP Training Academy, including but not limited to copyright or any other intellectual property rights related to the content, materials, and underlying templates including trademarks to logos, phrases and branding elements. Through examples, testimony, and comments appearing on the sales page, content, and community supporting OSP the names, logos and marks of other entities may appear on the Website but are the trademarks or service marks of those entities, and their appearance on the Website does not imply the endorsement of Erin Mortenson LLC by or affiliation of Erin Mortenson LLC with those entities, except as expressly indicated.
OSP provides general information for educational purposes only; OSP is not designed to and does not provide financial, investment, or tax advice through its Content. The information provided in this site, or through linkages to other sites, is not individualized business advice suitable for every situation, location, or business owner and Erin Mortenson LLC is not liable or responsible for any other information, services or product you obtain through this site that fails to produce a specific business result regardless of testimony or examples provided therein.
You should be aware that transmissions via the internet may not be secure prior to submission of information for purchase and access to the Content. Erin Mortenson LLC makes no
warranty or representation either express or implied that the Website or the servers through which OSP access is provided is free of viruses or other harmful components. Except as provided in the ErinMort.com privacy policy, Erin Mortenson LLC makes no warranty of the confidentiality or privacy of any communication or information transmitted through the use of the Website. Use of OSP is at your own risk and you assume full responsibility for risk of loss, corruption or breach of security of personal information resulting from your downloading and use of the Content.
The term of this Agreement shall commence upon your purchase of enrollment in OSP and extends throughout the designation of OSP Alumni and shall only conclude at the termination of the offering of OSP as a product. Understand there are no refunds under any circumstances regardless of satisfaction with OSP coaches or content. Upon termination of this Agreement, all of your rights to OSP and its Content terminate immediately.
Erin Mortenson LLC operates the Website in the United States. Erin Mortenson LLC makes no representation that the Website is appropriate or available for use in locations other than the United States. If you access the Website from locations outside of the United States you do so on your own initiative and at your own risk, and you are solely responsible for compliance with local laws, rules, and regulations, if and to the extent applicable. You may not access the Website from any country or territory where the content of the Website or the provision of the services through the Website is illegal. You may not use or export any of the materials constituting or available through the Website in violation of United States export laws and regulations.
If any provision of this Agreement is determined to be invalid or unenforceable under any applicable law, it shall be deemed omitted and the remaining provisions shall continue in full force and effect. This Agreement may be modified only in writing authorized by Erin Mortenson LLC. Erin Mortenson LLC's waiver of any right shall not constitute a waiver of that or any other right in the future. OSP is controlled and operated by Erin Mortenson LLC. This Agreement shall be governed by and construed in accordance with the laws and in the state and federal courts of the State of New Jersey, USA regardless of the location of purchaser or Erin Mortenson LLC. Erin Mortenson LLC makes no representation that this material is appropriate for users in other jurisdictions.
Notice or other communication between you, and Notice or other communication between you, and Erin Mortenson LLC may be given by conventional first-class mail or an overnight delivery service, such as FedEx or UPS that provides proof of delivery. Notices sent by first- class mail are effective on the fifth day after mailing. Notices sent by overnight delivery service are effective the next business day after they are sent. Notices should be sent to the attention of Shay M Lawson Esq c/o Tenom Noswal LLC at PO Box 15363 Atlanta, Ga 30333. Communications made through electronic mail or messaging shall in no way be deemed to constitute legal notice to or service of process on Erin Mortenson LLC or any of its officers, employees, agents or
representatives, including but not limited to any notice required by contract or by any federal, state or local laws, rules or regulations.
This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and all prior agreements, representations, statements, and undertakings, oral or written, are hereby expressly superseded and canceled.
BY USING THE SYSTEM GENERATED USERNAME AND PASSWORD TO ACCESS OSP YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND ACCEPT THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MUST PROMPTLY EXIT THIS PAGE WITHOUT USING THE SYSTEM GENERATED USERNAME AND PASSWORD OR ACCESSING THE CONTENT
